Nadeem Jiwa due back in court

Nadeem Jiwa and Baseer Mohammed Yousafzai were arrested back on August 2 by York Regional Police. The two were allegedly removing an airbag from a stolen car when Det.-Const. Robert Plunkett approached the car to make an arrest.

Police say Jiwa then attempted to drive away, and the attempt to flee police resulted in Plunkett becoming pinned against a tree by the car Jiwa was driving. Plunkett succumbed to his injuries.

Nadeem Jiwa was chared with first-degree murder:

Three days after Det.-Const. Robert Plunkett’s niece won the opportunity to carry the Olympic torch in memory of her uncle, the man charged with first-degree murder in the slain officer’s death made a court appearance.

Nadeem Jiwa, 19, of Toronto silently watched the front of a Newmarket courtroom this morning, clad in his familiar black Roca Wear short-sleeved shirt, blue jeans and shackles, as he was told his next court appearance is scheduled for Dec. 12.

He had been in custody since his arrest Aug. 2.

Mr. Jiwa was initially charged with manslaughter following Det.-Const. Plunkett’s death but the charge was upgraded.

Well, today is December 12, so hopefully we'll learn a bit more about how the case is progressing. Baseer Mohammed Yousafzai confessed to a number of thefts and will be out of jail soon:

One of the men arrested that morning admitted to a slew of theft offences Oct. 25.

Baseer Mohammed Yousafzai, 23, of Toronto pleaded guilty to one count of theft over $5,000, two counts of theft under $5,000, one count possession stolen property under $5,000 and two counts of breach of recognizance.

Mr. Yousafzai was sentenced to eight months in jail. He has been in custody since his arrest Aug. 2 and will serve another two months.

When he is released, he will be on probation for two years.

Baseer Mohammed Yousafzai was out on bail on charges related to a series of break-ins when Plunkett was killed.

It'll be interesting to know if Yousafzai provided police with information regarding how airbags are bought and sold on the black market, who was planning to buy the airbag being removed by him and Jiwa, and whether Jiwa had ever made any comment about what to do if police found them.

Much of that information would only be revealed in trial, and today's appearance might give us an idea of when a court on will determine the guilt or innocence of Nadeem Jiwa the charge of murder.
