Lawyers? The Deb Frisch saga continues:
I confronted Janke via email with what was going on and asked him to remove the posts so as to avoid giving this new whisper campaign a foundation on which to grow. Not surprisingly he refused, repeated the specious accusation and then claimed it’s my fault for not dealing with his smear that’s based on a lie.
So I’ve collected up all the relevant material and emailed it to my lawyer with the intention of initiating legal proceedings against Steve Janke and anyone else who propagates this new smear.
Janke’s accusation is based on the lie that Deborah Frischer threatened Jeff Goldstein’s child. She did not in fact, utter any threat.
Well, you know where the tip jar is.
Pssst, on the right, just below the Angry Beaver.
Update: Donations not required, thanks (besides whatever tips you think I deserve for my witty writing...<crickets chirping>). Warren Kinsella has commented to this post to say that he will be happy to represent me, gratis, in any proceedings. Not that he believes for a second that it will get that far. Any donations received will be returned (actually, I haven't completed any transactions since I did not expect to need them). And to the people in the legal community and from the media who have written or phoned with offers of support, thanks. I'll keep you posted on how things progress.
I didn't think I created the "foundation" for this. I thought McClelland did:
Frisch: Ooh. Two year old boy. Sounds hot. You live in Colorado, I see. Hope no one Jon-Benets your baby.
McClelland: Tough break. It's a hard way to learn that there's a double standard when it comes to death threats. The right can go on national tv and make them (ie. Adams Apple Annie) but the left never can; not even in a moment of anger on some paste eater's blog.
You shouldn't have resigned though. The right whingers only foam at the mouth for a short time before becoming distracted by their next 5 minute hate.
And for the record, it sure sounds like a threat to me. And the highlighted portion of McClelland's defence of Frisch makes it clear he took it as a death threat as well. Just one that wasn't worth getting excited about, given our short attention spans.
Update: Oops, a correction has been issued by McClelland:
Goldstein’s site was down when I wrote the comment and I’d only read a partial accounting of what Deborah had said. I erroneously gave her accusers the benefit of the doubt at the time. When Jeff’s site came back up I was able to read all her comments and determine no actual threat was made.
Robert McClelland, July 12th, 2006 at 7:47 pm
So you only supported her death threats when you thought they were death threats? And that changes things...how?
Funny you choose only now to share this enlightening "determination" of yours. After your "double standard" comment was brought up, I notice. I look forward to other "determinations".
In the comic book world, this is known as a "retcon".

McLelland and Frisch are excellent examples of the necessity for a 2nd Amendment analog in every country.
One has a right to defend oneself. Since they can't see that, you need to be able to demonstrate it.
Posted by: hershblogger at July 12, 2006 07:08 PM
People who actually plan to consult lawyers don't usually blow a lot of hot air about it first.
Sounds as though you hit a nerve with this twit and instead of admitting he showed poor judgement in supporting the vile Frisch and should know better, he is being offensive. Not going on the offensive, being offensive.
Hang tough and keep updating the situation. Your blog is great, classy and always interesting. I don't think you have a thing to worry about.
Posted by: Selma at July 12, 2006 07:11 PM
If I were you, I'd worry more about the Mohawk Warriors rather than RM.
Posted by: at July 12, 2006 07:14 PM
Don't worry about it. McClelland isn't Kinsella; he doesn't have the resources to pursue you in this manner.

As if McLa-La-Land could show any more signs of how utterly pathetic he is. What a joke... To think people actually take this guy seriuosly.
Rack this up to being further proof of how seriously out of touch with reality this idiot is. The fact that he needed to print a "correction" only shows how many straws this guy has grasped at.
Keep up the good work Steve. Perhaps McLa-La-Land will will wake up and realize that what you do is distinguished and what he does is extinguished... as in, whatever fire he had, he put it out a long time ago.
Posted by: Surecure at July 12, 2006 08:15 PM
Why are you people still paying any attention to RM? I think I read his blog once a year or so ago, and haven't bothered since. It just isn't worth anyone's time.
Posted by: Ed Minchau at July 12, 2006 08:21 PM
Ed, I think it's because he's kind of like Jack Layton... he doesn't really matter in the grand scheme and mostly sounds like a broken record (i.e. count how many times he calls conservatives pro-apartheid and pro-genocide in a sentence), but he makes enough noise that you have to at least mention him if only to remind people why they should be ignoring him.
I know, it's paradoxical... but unfortunately it's unavoidable.

Aparently it's the Vast Right-Wing Conspiricy revisited:
"Ti-Guy Says:
July 12th, 2006 at 7:37 pm | |
This seems coordinated. Janke writes that post, Kate shows up at Prog-Blogs and Richard Evans went gunning for me yesterday and today (despite, as far as I know, not having anything to do with him since January).
I think the proto-fascists have adopted the tactic we’re seeing quite bit in the States and which the Deb Frisch/Count Cockula affaire illustrated so well this weekend….bloggity-blah being re-directed into material threats of actual people. That’s what the rethuglicans do, after all, and the CPC supporters are following the script.
Janke’s smear implied that you posed a material threat to his child. That’s a complete fabrication."
Posted by: Richard Evans at July 12, 2006 09:43 PM
Oh gawd... I just had to read remarks from Nice-Try-Guy? I thought I got away from him when I stopped reading McLa-La-Land's blah-blah-blech cheap dung last year.
And of course, the vast right-wing conspiracy looms in every syllable. "It was coordinated! I have the underwear stains in my pants to prove it!"
Posted by: Surecure at July 12, 2006 09:48 PM
If he actually is stupid enough to go through with this -- which I can't see happening because he'd have to find a lawyer stupid enough to go through with this -- you'll have it made with the countersuit.
What smear is he talking about, anyhow? That you said you don't want his deluded, amoral excuse for a self around your kids? That's illegal in his world? Better include me in the suit too, LaLa, because I wouldn't even let you come near my dog. While I'm confident you pose no actual threat to him, as he'd simply outsmart you, my noble friend doesn't deserve the annoyance.

Re Peters comment about Kinsella. Angry, I hope McLelland does pursue you legally and that you retain Kinsella for your defence. Not that I'm a fan of Warrens, for I think his political bent is more left than right, for I think Kinsellas ideology in the courtroom is just win baby. It would be a taking down of the far left by the not so far left and very entertaining.
Posted by: ward at July 13, 2006 12:10 AM
Kinsella immediately came to my mind too: Who is a wicked good lawyer? KINSELLA! The fact that he has had his own dealings with RM just makes it fascinating.
Just imagine RM losing and having to pay Steve's legal costs which would be Kinsella, that would be quite the coup indeed!

Make a court case out of it.
I've had more pointed threats from harried moms at the ice cream truck line-up than what was said here or over at Robert's.
Take it to court.
Get nailed for frivolous lawsuits, you crybabies.

And you gotta love how Ti-Guy then turns this into an attack against Christianity, and and accuses people like me of being the reincarnation of the Nazis...

Store that one away for your counter-suit Steve. ;-)
What's the name of that defence again? (yea, the one that says you automatically lose as soon as you compare someone to Hitler or the Nazis...)

I'd quit digging if I were you, Steve. You run a pretty level-headed conservative site, but putting Robert's name up in lights like that was well beneath your usual standards.

OK, no homophobic jokes. They're in bad taste, and not even on topic. Let's keep it civil and intellectually honest, ok?
Posted by: Steve Janke at July 13, 2006 11:37 AM
He'll go to a lawyer full of bile and bluster. The lawyer will look at the situation and laugh at him. He will drop the whole matter just as he did with his infamous and considerably stupid post that attracted Kinsella's attention.
Consequently, the entire matter will demonstrate that the label 'extremist' is vastly more applicable on the left side of the page, particularly since we have now witnessed a Conservative government acting rather rationally - the Canadian voter no longer buys the 'extreme right wing' poppycock.
Therefore, ironically, that bag of hot air has quite adroitly helped the cause of conservatism in Canada. Thus is so often goes for the self-righteous, sanctimonious and extreme far left where that infamous dipper blahgger now resides.

He seems to be all over the map with this topic. Probably not worth pursuing, as it may be merely a publicity stunt.

I've told SJ that I (and others, if necessary, but it won't be) will gladly assist, gratis. You cannot sue for a damaged reputation if you lack one to start with.
But it's all a lot of noise signifying nothing. McLelland is a fool and a coward.
